These terms apply to all quotes and works carried out by Hands On Property Maintenance ("we", "us"), 15 Maylands Way, Harold Wood, Romford, Essex RM3 0BG. By accepting a quote or instructing works, you agree to them.
1. Quotes and prices
- Quotes are based on what we could see and were told at the time. If we find something that changes the work, we will tell you and agree any extra cost before going ahead.
- We are not VAT registered. No VAT is added to our prices.
- Materials are included in the quote unless it says otherwise.
2. Authority to instruct works
By instructing us, you confirm that you own the property or are authorised by the owner or managing body to instruct the works, and that you accept responsibility for payment. We are not responsible for disputes about ownership, tenancy or authority to instruct, and you agree to cover any costs or claims arising from works you were not entitled to instruct.
3. Access and site conditions
- You agree to give us safe access at the agreed time, and to tell us about any hazards, residents' needs or site rules we should know about.
- If we cannot gain access at an agreed time, we may charge for the wasted visit.
- Where parking or congestion charges apply and parking is not provided, these may be added to the invoice.
4. Cancellations
Please give us at least 24 hours' notice to cancel or move a booked visit. Late cancellations may be charged.
5. Payment
- Payment is due within 30 days of the invoice date unless agreed otherwise in writing.
- For planned maintenance contracts, invoicing is per visit or annually in advance, as agreed.
6. Planned maintenance contracts
Contracts run for 12 months and renew each year unless either side gives 30 days' written notice to cancel or change them. Work outside the agreed scope is quoted and approved before we start.
7. Existing conditions and hidden services
- We are not responsible for defects that existed before we started, or for conditions we could not reasonably see, such as rot, weak masonry, asbestos or failed waterproofing.
- We take reasonable care to avoid hidden pipes and cables, including using detection equipment where appropriate. We are not liable for damage to services that were concealed and not shown to us.
- Please tell us about any asbestos, fragile roofs or rooflights, and anything else on site that could affect safety.
8. Adaptations and specifications
Where an occupational therapist, client or consultant specifies an adaptation, they are responsible for whether it suits the user's needs. We are responsible for installing it properly. If we believe a specified position or product is unsafe or unsuitable for the building, we will tell you before going ahead.
9. Materials
Materials remain our property until the invoice has been paid in full.
10. Late payment
For business clients, we may charge interest and compensation on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.
11. Our responsibility
- We carry out work with reasonable care and skill and will put right any fault caused by our workmanship that you report to us promptly.
- We are not liable for indirect or consequential losses, such as loss of rent, income or business.
- Our total liability under any job is limited to the price of that job.
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
12. Consumers
If you are a consumer and agree the work away from our premises or at a distance, you normally have 14 days to cancel. If you ask us to start within those 14 days and then cancel, you pay for the work done up to that point. Nothing in these terms affects your statutory rights.
13. Subcontractors
We may use suitably qualified subcontractors for parts of the work, for example certified electrical work. We remain responsible for the work we have agreed to do.
14. Insurance
We hold public liability insurance. Details are available on request.
15. Law
These terms are governed by the law of England and Wales.
